What Are Incoterms?

Incoterms (International Commercial Terms) are a set of 11 trade terms published by the International Chamber of Commerce (ICC), most recently updated in 2020. Each term defines exactly where the seller's responsibilities end and the buyer's begin — covering risk transfer, transport costs, insurance, and customs obligations.

The Most Common Pitfalls for East African Importers

1. Accepting FOB Without Understanding Port Risk

FOB transfers risk to the buyer once goods are loaded onto the vessel. Any loss during ocean transit is the buyer's risk and must be covered by the buyer's marine insurance.

Best practice: Request marine cargo insurance for all FOB shipments, covering the full voyage to your warehouse.

2. The EXW Hidden Cost Problem

EX Works requires the buyer to bear all costs from the supplier's factory gate: export clearance, freight, import duties, and local delivery. For importers without freight forwarding experience, EXW often results in significantly higher total landed costs.

3. CIF Insurance Undervaluation

Under CIF, the seller provides insurance for only minimum cover (110% of invoice value). Importers who accept CIF often discover that specific risks (e.g. theft during port storage) are excluded.

Customs Clearance Notes for Uganda

All imports into Uganda must be declared to the Uganda Revenue Authority (URA) through the ASYCUDA++ system. Required documents:

  • Commercial Invoice (showing Incoterm)
  • Packing List
  • Bill of Lading or Airway Bill
  • Certificate of Origin
  • Import Declaration Form (IDF)

Note: Uganda applies a 3% Railway Development Levy (RDL) on all imports, calculated on the CIF value.

Conclusion

Incoterms directly determine your cost exposure, insurance obligations, and risk management strategy. East African importers who negotiate terms from an informed position consistently achieve lower landed costs and fewer supply chain disruptions.
